Busia county Senator Hon Okiyah Omtatah has finally broke his silence hours after winning the case on introduction of 50 Chief Administrative Secretaries (CASs) against President Ruto.

In a ruling by the High Court last evening, the President’s move to appoint and swear-in the 50 CASs was unconstitutional. This therefore rendered his allies jobless just weeks after assuming office.

The court cited that it was absurd for 50 CASs to deputize only 22 Cabinet Secretaries, based on the description given to the positions. The absence of proper public participation was also another ground through which the 4 High Court judges struck out the CAS appointments.

Okiyah Omtatah was among the petitioners on the case, accusing the President of violating the constitution of Kenya.

Speaking during the NewDawn show at K24 on Tuesday morning, Okiyah Omtatah informed that public participation is a key issue that should be given utmost attention with regard to making government implementations and appointments.

He stated that even on the 2023 Finance Bill that’s also hanging on the balance awaiting the July 5 ruling, there was no public participation. Court announced temporal stoppage of implementation of the Finance Act until July 5 when key matters are set to be heard and determined.

Okiyah affirmed that Kenyans had overwhelmingly said no to the Finance Bill but President Ruto’s representatives went ahead and did otherwise.

“Public Participation is not an opportunity to inform people of what you are doing. That is what has happened with the Finance Bill where Kenyans overwhelmingly said no but the representatives went ahead and did what they did,” Sen Omtatah said.

Could this mean that the President could be handed another bad news ?
