Former Chief Justice Willy Mutunga revealed that he attempted to offer advice to the current Chief Justice, Martha Koome. According to Mutunga, the Judiciary is a political office rather than a purely constitutional one, and he advised the current leadership to safeguard its independence and avoid becoming subservient.
In his counsel to CJ Martha Koome, Mutunga encouraged her to maintain regular engagement and provide advice as needed. He also emphasized the importance of the political class respecting the Judiciary, as it serves as the last resort for addressing any issues.
“You are dealing with politicians; they don’t want to be told what the law is. You need to talk to them about the political consequences of their actions,” he added.
During a TV interview on Wednesday night, Mutunga also commended President Uhuru Kenyatta for his respect towards the Judiciary during his tenure, noting that the President used to consult the institution.
“We had a good a relationship, he is a warm guy, and he used to listen to advice save for when he refused to swear in the judges as recommended by the judicial service commission but we handled it politically,” he noted.
