Justin Timberlake’s DWI drama in the Hamptons has taken a strange turn as his legal team claims that police let his friend – who had also “clearly” been drinking – drive home in his car after his arrest.
Timberlake, 43, was arrested around 12:30 a.m. on June 18 when a Sag Harbor Village police officer pulled him over in the village in the Hamptons, New York, for allegedly running a stop sign and drifting out of his lane while driving a 2025 BMW X7, according to court documents.
The star told the officer he had one martini and was following some friends home. He was later charged with drunk driving.
Timberlake’s attorney Edward Burke, Jr. — who has maintained that the singer was not intoxicated at the time of his arrest — is now reportedly seeking to allege that arresting officers allowed a man who was “clearly” intoxicated to drive away — while they were arresting Timberlake.

Inside the car were a woman and her husband. The woman asked one of the officers, “Are you going to arrest Justin Timberlake?”
She then allegedly offered to drive Timberlake to their home, where he spent the night, but Timberlake was arrested.
According to the sources, the woman had asked the police if she could take the singer’s rental car to her house. The police agreed, after which she drove away with the car.
It was alleged that the unidentified woman had arrived at The American Hotel two hours before Timberlake, where he was drinking his famous martini, and that she was drinking.

Burke, Jr. – who is seeking to have the case dismissed – will reportedly argue that police were “completely wrong” in their judgment and allowed a person who had “clearly been drinking to drive away right in front of them.”
“If they couldn’t judge her properly, how could they judge him properly?”
Burke will reportedly present this argument to the judge as part of a motion to dismiss the case. Timberlake is expected to appear virtually on Friday, August 2, as the arraignment is on one count of driving under the influence.

Burke reportedly said in court that prosecutors had failed to “obtain the signature of a superior on the indictment — and therefore the case should be dismissed.”
He said: ‘The police made some very serious mistakes in this case.
“Today in court you heard the prosecutor try to correct one of those mistakes. But that is just one and there are many more. Sometimes the police make mistakes and this is just one of those cases.”
Timberlake was not present in court on Friday and did not appear virtually, as he is currently in Poland for his Forget Tomorrow World Tour.

Timberlake’s alleged intoxication was detailed in court documents: “His eyes were bloodshot and glassy, his breath smelled strongly of alcohol, he was unable to focus, his speech was slower, he was unsteady on his feet, and he scored poorly on all standardized field sobriety tests.”
“This is going to ruin the tour,” the star is said to have muttered.
The New York agent – who was too young to recognize Timberlake – asked, “What tour?” but was told, “The world tour.”
After being arrested and taken to a police station in nearby East Hampton, he refused to submit to a breath test, according to court documents, which describe him as a “professional” and “self-employed.”

Jessica also served as an executive producer on the 2022 Hulu biographical crime series Candy, where she played accused murderer Candy Montgomery, and Justin had a recurring role on Candy as Deputy Sheriff Steve Deffibaugh.
