Legal Analyst Mpumelelo Zikalala has lambasted the Acting Public Protector for interpreting the constitution narrowly, which made her to exonerate president Cyril Ramaphosa of all wrongdoings. Zikalala said that the Acting Public Protector succeeded in narrowing the interpretation of the constitution of the Republic of South Africa. He noted that by all permutation, the money found in phala phala farm was for business. The money was found on Ramaphosa’s farm. Ramaphosa owns the business; hence he owns the money. He argued that the constitution is not ambiguous, but the Acting Public Protector decided to narrow down the interpretation for reasons best known to her. Many people have been commenting on the Acting Public Protector’s pronouncement of not finding Ramaphosa guilty of any wrongdoing. It has generated much heated controversy on social media.
Furthermore, the journalist queried why the Acting Public Protector should narrow down the constitutional interpretation of the Executive Member’s ethical codes when she knows it is not the right thing to do. She was quoted as saying during the interview, “The Constitution is clear in Executive Ethics Code Sec 96, 2a, and b that cabinet members, and their deputy ministers can’t undertake any other paid work. Surely, when we talk about finding money on-premises belonging to someone, we’re talking about payments, and money”. She further argued that the president himself admitted that he is into business, saying in one of the videos online that he is into buying and selling of animals. They wonder why the Acting Public Protector will still narrow down the constitutional interpretation of the Executive member ethical Acts after watching videos of the president admitting that he is into business.
