“The Citizens Can Withdraw Their Delegation Of Sovereign Power And Exercise Directly” Mutunga Says

Former chief Justice of Mutunga has said that the Citizens can withdraw their delegation of sovereign power and exercise directly.

Responding to Netizen’s tweet the former chief Justice of Kenya Mutunga said that the Kenya’s constitution is unique.

“When a president suspends the Constitution which he swore to uphold and protect, he loses the legitimacy of his office which he exercises on behalf of we the people and invites removal from office by the people. That is the essence of Article 1 of the Constitution”. Said Netizen.

“This is a glaring example of why our Constitution is transformative. This is a citizen’s control of how political power is used and how to ensure the Constitution is upheld, respected, and defended.

Article 1(1)&(2): The people can withdraw their delegation of sovereign power and exercise directly. Also relevant is Article 3(2). A petition to court can get the relevant orders for this withdrawal of delegated sovereign power and how direct use of it by citizens can take place”. Said former Chief Justice Mutunga.
