Prime Cabinet Secretary Musalia Mudavadi has received a major blow after High Court received a petition to nullify his seat as unconstitutional.

This comes even as the Kenya Kwanza administration plans to have the office embedded in law.

The office of the Prime Cabinet Secretary was created by Executive order No. 1 of 2023 by president William Ruto.

According to chapter nine, article 152 of the Kenyan Constitution, “The Cabinet consists of the President; the Deputy President; the Attorney-General; and not fewer than fourteen and not more than twenty-two Cabinet Secretaries.

Earlier, Lawyer Miguna Miguna defended Musalia’s position against those calling for its nullification.

According to Miguna, the Prime CS job falls within the constitutional limit of 22 CSs.

He explained that the name Prime does not give it any special consideration.
