Data Processing And Compliance Officer And Loan Recovery Assistant Open At Mhasibu Sacco

We are a dynamic, well-established Savings and Credit Co-operative Society in the country for all professionals with membership spread globally. We are seeking to recruit highly qualified result-oriented individuals for the following positions:

DATA PROCESSING AND COMPLIANCE OFFICER

Legal Manager

2. JOB PURPOSE
The officer will be responsible for development, implementation, guideline and compliance with the Data Protection Act, Anti Money Laundering Act (PROCAMLA), Risk Management guidelines, SASRA guidelines and all the relevant laws and regulations. The position holder will ensure the Sacco has in place effective risk management structures and remains compliant in-service delivery to members.

3. MAIN RESPONSIBILITIES OF THE JOB
a) Ensuring compliance with the data protections laws and policies of the Sacco.
b) Develop, implement, and maintain data protection policies, procedures, and guidelines that align with Kenyan laws and regulations.
c)Prepare reports on data protection and compliance activities, including updates on compliance status, identified risks, and remediation efforts, for management and regulatory authorities as required.
d)Sharing reports on data protection and data processing activities impact assessments, in line with data protection law and ensure appropriate safeguards are in place.
e) Driving implementation of essential elements of DPA such as principles of data processing and data subject rights.
f) Maintain records of data processing activities, including data flows, data transfers, and data security measures to demonstrate data protection compliance.
g) Provide training and awareness programs to the Sacco on data protection and compliance, including best practices for data handling and protection of personal information.
h) Establish and oversee procedures for managing data breaches, including incident response, notification, and mitigation, in accordance with Kenyan laws and regulations.
i) Evaluate and monitor the data protection practices of third-party vendors and service providers to ensure compliance with Kenyan data protection laws.
j) Handle data subject requests related to data access, rectification, erasure, and objection, ensuring timely responses in compliance with Kenyan data protection laws.
k) Act as the point of contact between the organization and the office of the Data Protection Commissioner, facilitating communication and collaboration on data protection matters.
l)Creating, implementing, and regularly reviewing an effective compliance program.
m)Steer compliance operations to facilitate a more robust and proficient approach and ensure control gaps are closed.
n) Understand and keep up to date on all compliance-related regulations, including but not limited to the Proceeds of Crime and Anti Money Laundering Act (PROCAMLA), Data Protection Act, SASRA Regulations and all relevant Acts governing the Sacco.
o) Implement and monitor changes and new controls introduced, and ensure changes are embedded into the operations.
p) Create and manage effective risk management action plans in response to reviewed discoveries and compliance violations.
q) Developing educational programs on all relevant laws and regulation s for all employees and other stake holders working with the SACCO.
r) Assist in follow up on legal matters as guided by the Legal manager.
s) Any other duty as assigned by supervisor.

4. KNOWLEDGE, SKILLS, AND EXPERIENCE
Minimum level of academic qualification, skills and knowledge required to perform effectively in the role:
a) A Bachelor of laws degree from a recognized institution.
b) Successful candidates will be required to meet the requirements of Chapter 6 of the constitution of Kenya by obtaining the necessary documentation.
Minimum level of professional qualification required to perform effectively in the role:
a) A postgraduate Diploma in Legal Studies from the Kenya School of Law
b) A member in good standing with LSK
c)An advocate of the High Court
Minimum months or years of experience required to have to be appointed to the position:
Minimum 3 years relevant experience and in a similar position.

5. KEY PERFORMANCE INDICATORS
a) Society compliance status with relevant bodies
b) Comprehensive monthly reports on Risk Management, Data Protection, and compliance matters
c) Effective communication
d) Level of SACCO stakeholders’ awareness on relevant laws and regulations
e) Risk management and compliance structures in place
f) Incident cases and reports

6. SKILLS & COMPETENCIES
a) In-depth knowledge of Kenyan laws, and other relevant regulations.
b) Proven experience in data protection, Anti Money Laundering, compliance, or a related field, preferably in a regulated industry.
c) Familiarity with data processing operations, and Data privacy best practices.
d) Strong analytical, attention to detail and problem-solving skills.
e) Excellent communication and interpersonal skills to effectively collaborate with stakeholders at all levels.
f) Experience in managing risks, Data incidents and breaches.

g) Good knowledge of the market and the Society’s products and services.
h) Self-confident and Motivated.
i) Good people, interpersonal and networking skills.
j) Proficient in Microsoft office suite.

LOAN RECOVERY ASSISTANT- SHORT-TERM CONTRACT FOR A PERIOD OF ONE (1) YEAR.

Loan Recovery Assistant Finance Recovery

Loan Recovery Manager Short term – 1 Year Nairobi

2. JOB PURPOSE
Follow up on non-performing loan accounts (Doubtful and Loss Category) and implement a recovery action plan to achieve timely and maximum loan recovery, with the objective to minimize portfolio at Risk (PAR).

3. MAIN RESPONSIBILITIES OF THE JOB
a) Daily monitoring of allocated portfolio of delinquent loan portfolio (Doubtful and Loss Category) to determine reasons for delinquency by application of sound credit judgment and collections strategies to minimize credit losses.
b) Negotiate amicable resolutions in Recoveries for the assigned portfolio, taking into consideration their financial circumstances and our company’s guidelines.
c)Regular contacting of members in default through calls, emails, visits and other collections channels to discuss outstanding debts and establish repayment arrangements.
d)Maintain accurate and detailed records of all communications and payment agreements with debtors, ensuring timely updates and documentation of progress.
e) Meet and exceed assigned collection targets and objectives, demonstrating strong motivation and determination to reduce PAR and surpass collection targets.
f) Deliver a high level of customer service, ensuring members feel respected and supported throughout the collections process.
g) Ensure that quality and timely periodic reports on assigned portfolio are prepared for management review.
h) Recommend strategies and methodologies to reduce volume of past due accounts.
i) Any other duty as assigned by the supervisor.

4. KNOWLEDGE, SKILLS AND EXPERIENCE
Minimum level of academic qualification, skills and knowledge required to perform effectively in the role:
a) A Bachelor’s Degree in Finance or Accounting or Credit Administration or Co-operative Management or any other related field.
b) Successful candidates will be required to meet the requirements of Chapter 6 of the constitution of Kenya by obtaining the necessary documentation.
Minimum level of professional qualification required to perform effectively in the role:
Professional qualifications in CPA or Credit Management. A member of a relevant professional body will be an added advantage.
Minimum years of experience required to have to be appointed to the position:
A Minimum of 2 years relevant experience.

5. KEY PERFORMANCE INDICATORS
a) Percentage Reduction in doubtful and loss category PAR
b) Effective and timely communication.
a) Timely reports on loan recovery.
c) Percentage of outbound calls/visits resulting in promise to pay.
d) Number of accounts converted from non-performing to performing.
e) Total collection as a percentage of outstanding portfolio.
