Three men face assault charges after an altercation at a Patriots game last month resulted in the death of Dale Mooney.

The Foxborough Police Department said it has filed a criminal complaint for battery and disorderly conduct against the Rhode Island trio.

Dale Mooney, 53, collapsed and died following an incident at Gillette Stadium last month after being hit by a rival Miami Dolphins.

Prosecutor Michael Morrissey confirmed the problem was a potential factor in her death, but that the case would require further testing.

He added that the two blows delivered by the Dolphins fan did not cause fatal injuries to Mooney.

Disturbing footage showed the father of two and longtime Patriots ticket holder, who donned a No. 10 Mac Jones jersey, being tossed around by a Dolphins fan.

The punch connected, with eyewitnesses saying Mooney fell to the ground moments later during the huge brawl.

He was then rushed to a nearby hospital before being pronounced dead.

Gillette Stadium released a statement regarding his death, confirming it was “assisting” with the investigation.

“We are heartbroken to learn of the tragic passing of Dale Mooney, a longtime Patriots fan and 30-year season ticket member, who died while attending Sunday night’s Patriots game,” they said .

Mooney’s wife, Lisa, said her husband was a longtime Patriots fan and had been a season ticket holder for 30 years.

The father-of-two has been described as having the “patience of a saint”, who once risked his own life to save a child stuck between rocks near a pier in Hampton Beach.

Mooney, who was 39 at the time of the incident in 2009, rushed to help the girl who was trying to free her bodyboard from the rocks, according to Seacoastonline.

“The waves were hitting her and she couldn’t even stay standing,” Mooney told the outlet. “She kept falling between the rocks, trying to keep her head above water, we were both quite scared at that point.”

His distraught wife Lisa told WCVB: “Numb. I just feel numb. I can’t even believe this is real. It takes a lot to make him angry and he has the patience of a saint. I just don’t understand what happened.

A witness, Joey Kilmartin, told the Boston Globe that Mooney had been fighting verbally for most of the match.

Mooney allegedly went to confront the Dolphins fan during the fourth quarter of the game and was punched twice in the head.

“In a nutshell, it was a basic argument,” Kilmartin said. “He went to section 311 and engaged in a mutual fight with another fan.

“A lot of people started trying to separate them. … It looked like someone was in their midst, and then a man wearing a Dolphins jersey leaned over and punched the victim twice in the head.

“It wasn’t anything crazy or out of the ordinary until, 30 seconds later, the guy wasn’t getting up.”
