Deputy President Rigathi Gachagua stands to exit with a lavish retirement package if he resigns before the Senate convenes to discuss his impeachment. He was recently impeached by the National Assembly, where 281 lawmakers voted to impeach, with 41 against, and Babu Owino, a no show.
Now, his fate rests in the hands of the Senate, where Gachagua needs at least 23 Senators to support him in order to avoid removal from office.
If he fails to gather enough votes, he risks not only losing his position but also significant retirement benefits that typically come with the role.
What Benefits will Rigathi Gachagua Get upon Resigning?
According to the Retirement Benefits Act of 2015, former Deputy Presidents enjoy various perks, including a monthly pension that amounts to 80% of their last salary while in office.
They also receive a lump sum payment based on their years of service, two official cars—one saloon and one four-wheel drive—replaced every four years.
And a fuel allowance equal to 15% of their current salary.
Additionally, they are entitled to comprehensive medical coverage for both local and international treatment, staff provisions, armed security on request, a diplomatic passport, and access to VIP lounges in Kenyan airports. By choosing to resign before the Senate’s hearing, Gachagua could potentially safeguard these benefits and avoid the consequences of impeachment.
On the other hand, while Gachagua might initially retain his benefits if he resigns, Parliament can still pass a motion to strip him of those benefits if he is impeached.
As the Senate gets ready to meet, Gachagua must make some tough choices about his political future. Resigning could help him leave office comfortably, but if he decides to fight the impeachment, he risks losing everything.
Gachagua might also look into legal ways to challenge the impeachment. If any part of the process is found to be unconstitutional, it could weaken the whole effort.
