DJ Fatxo’ s lawyer, Duncan Okatch, wrote the letter on his behalf, stating that his client has been negatively impacted by reports connecting him to Mwathi’ s death, which has been alleged to be suicide.

She believes that her son was murdered and not that he committed suicide, as alleged. Furthermore, she wonders why no one has been arrested concerning Jeff’ s death, especially after DCI’ s investigation report, which remains inconclusive, with suicide being the strongest explanation for his death.
Ms. Mwathi is disappointed by the delay in the Directorate of Public Prosecution’ s decision- making process and the lack of communication regarding the investigation’ s status. DJ Fatxo’ s lawyer notes that there is a growing concern about the delay in communicating the investigation’ s results, and the latest concerns come from Jeff Mwathi’ s parents.
According to DJ Faxto, the delay has led to unfortunate insinuations from Jeff’ s parents, which the public may understand plausibly and cement such perceptions. So, the lawyer would like the Directorate of Public Prosecutions to make haste in making recommendations regarding the file forwarded to their office by the DCI. The DCI completed its investigations into Jeff Mwathi’ s death on April 19, 2023, and handed over the file to the Directorate of Public Prosecution’ s office for further action.
The investigation’ s conclusion means that the decision to prosecute, review or not prosecute DJ Fatxo now rests with the Directorate of Public Prosecutions.
