A day after a video of two schoolgirls falling out of a moving van went viral on social media, the Makarpura police station in Vadodara city, on Saturday, arrested two persons, including the owner of the van and the driver, for rash and negligent driving and also for endangering the life of persons.

The alleged incident occurred at noon on Wednesday when the driver of the school van was dropping off students of a private school in the Makarpura area. The FIR, lodged by police sub-inspector R J Kalsava of the Vadodara city traffic department at Makarpura police station states that on examining the viral CCTV footage, it turned out to be that of Tulsidham society on Novino Road.

The driver of the vehicle has been identified as Pratik Padhiyar while the owner has been identified as Jigneshkumar Joshi.

In the video, two schoolgirls are seen tumbling out of the van with their school bags as the vehicle moves ahead. The clip further shows residents rushing to help the students, one of whom is seemingly in discomfort.

Another student from the van as well as the driver are seen rushing into the frame a few seconds later even as a resident picks up one of the students — an eight-year-old girl — and takes her inside a house to administer first aid.

Kalsava, in his FIR said, “After identifying the driver, when he was called for questioning, he told the police that he had forgotten to lock the rear passenger door of the school van (a Maruti Eeco model) and therefore, as the door suddenly slid open, two students fell off the moving van along with their bags. On being questioned, the driver shared the details of the two students. When we contacted the mother of one eight-year-old, she said that since the child had only sustained minor injuries, they did not report to the police.”

The FIR further states that Padhiyar had no permanent license and was driving the van on a learners’ license while the owner of the van had not sought an RTO permit to ferry school students.

The complaint further reads, “The driver, aged 23, has a learner’s license that is valid from January 1, 2024 to July 3, 2024. He produced his application number for a permanent license. On inquiring about an RTO permit to use the van for ferrying school students, it came to light that the owner of the vehicle did not apply for one.”

The two accused have been booked under Indian Penal Code (IPC) Sections 336 (act rashly or negligently as to endanger human life or the personal safety others), 337 (causing hurt to any person by doing any act rashly or negligently as to endanger human life, or the personal safety of others) and 114 (abettor present when crime committed) as well as relevant sections of the Motor Vehicle Act.
