More trouble for former Samburu governor as bond is cancelled after conviction in Ksh83M case

Former Samburu Governor Moses Kasaine Lenolkulal will spend a night in the cold after a Nairobi Anti-Corruption Court cancelled his bond after he was convicted in a Ksh83 million case.

According to a ruling delivered by the court on Wednesday, August 28, 2024, following submissions lodged by the prosecution led by Alex Akula, Wesley Nyamache, Delroy Mwasaru, and Rebecca Wangusi, the former governor will spend the night b*********s, awaiting his sentencing.

The former Samburu governor will then be presented in court on Thursday, August 29, 2024, to know his fate.

Conviction

In a statement shared by the Office of the Director of Public Prosecution (ODPP), Lenolkulal, along with eight former County Chief Officers and a businessman, were convicted by a Nairobi Anti-Corruption court for conflict of interest, unlawful acquisition of public property, and a***e of office.

Chief Magistrate Thomas Nzyioka determined that the prosecution, through eleven witnesses, presented compelling evidence against the accused.

“Lenolkulal and businessman Hesbon Jack Wachira were found g****y of unlawfully acquiring Ksh83,345,255 in public property an offence they committed between March 27, 2015, and March 25, 2019, within Samburu County,” ODPP’s statement read in part.

“In addition, the former governor was convicted of Conflict of Interest after the court found that, as the Samburu County Governor and sole proprietor of Oryx Services Station, Lenolkulal had a private interest in contracts between his business and the Samburu County Government for fuel supply during his tenure,” it added.

The eight other officials were convicted of A***e of Office under Section 46, as read with Section 48(1) of the Anti-Corruption and Economic C****s Act, 2003.

They will all be sentenced on Thursday, August 29, 2024.
