Canadian rail workers ordered to stay, railways benefit

Over 9,000 Canadian rail workers have been ordered to remain at work, a development seen as beneficial for railways and potentially influential in other federally regulated sectors like aviation. Paul Boucher, president of the Teamsters Canada Rail Conference, stated that the union will comply with the order but is preparing a legal challenge against the decision, which halted work stoppages and imposed arbitration at the country’s two largest railways.

Boucher noted that while the decision is favourable for federally regulated companies, it poses a significant setback for labour and workers’ rights. The Canada Industrial Relations Board’s ruling came after Labour Minister Steven MacKinnon asked for intervention in the negotiations between the Teamsters, Canadian National Railway (CN), and Canadian Pacific Kansas City (CPKC). The dispute resulted in an unprecedented lockout at both freight rail carriers, leading to major disruptions that affected Canada’s export-driven economy.

CN expressed satisfaction that the labour stoppage had ended but indicated a preference for a negotiated agreement. Spokesperson Jonathan Abecassis mentioned that CN had attempted to reach an agreement over nine months, making five offers to improve wages and working conditions, which the union did not accept. Both railways are now focused on restoring service, with the Teamsters planning to appeal the decision in federal court.

Boucher has called on labour groups across Canada to support their cause, suggesting other unions might participate as intervenors in the legal case. He emphasised the importance of this moment for the labour movement, indicating that broad involvement is expected.

The union’s disagreement with CN and CPKC centred on scheduling, shift durations, and availability. CN proposed extending shifts to 12 hours from the current 10, a move opposed by the union. Boucher, who has a background of balancing an on-call rail job while raising a child as a single parent, has been negotiating from a downtown Montreal hotel.

The decision’s impact extends to other sectors, with Air Canada pilots, who recently approved a strike mandate, pressing for a new contract. Air Canada aims to reach a negotiated settlement with its pilots soon. The Air Line Pilots Association and CPKC did not immediately comment on the situation. Additionally, a spokesperson for Canada’s labour minister was unavailable to comment on whether the decision would set a precedent for other sectors, including aviation.
